Return and Refund Policy

RENTAL CONTRACT-TERMS AND CONDITIONS

(1) The rental equipment has been received in good working condition, and will be returned in the same condition, ordinary wear and tear excepted.

(2) Customer assumes all responsibility for injuries to persons or damages to property from the moment of delivery of equipment to the moment of return and agrees to hold South Rentals of Alabama harmless for any and all claims of whatsoever nature, arising out of use of the rental equipment, as stated in the Indemnity/Hold Harmless section below.

(3) Customer agrees that South Rentals of Alabama has the right to enter premises of customer at any time to repossess said equipment. Customer hereby waives any rights of action against South Rentals of Alabama by reason of such taking or entry and agrees to reimburse South Rentals of Alabama's cost of repossession.

(4) Customer agrees to reimburse South Rentals of Alabama for all attorney's fees, (in an amount not less than 26% of all sums due), court costs and expenses incurred by South Rentals of Alabama to enforce collection of all sums or to preserve or enforce South Rentals of Alabama's rights under this contract.

(5) Customer agrees not to loan, sublet or otherwise dispose of equipment or use at any other location than listed on the front of the contract.

(6) PAYMENT

a. Customer agrees to pay South Rentals of Alabama upon demand:

1) All rates, charges, taxes, fuel, delivery pickup and reservation cancellation fees and all other amounts incurred as a result of this rental transaction.

2) Replacement cost for any loss or disappearance of equipment due to theft, conversion or other dishonest acts on the part of any person or persons to whom the equipment is entrusted or any person, persons in the service or employment or the Customer whether or not occurring during the hours of such service or employment.

b. Credit Card - Customer authorizes South Rentals of Alabama to bill Customer's credit card at time of reservation or upon receipt of rented item(s) or upon the return of the item(s).

c. Payment Guarantee - If I have directed South Rentals of Alabama and South Rentals of Alabama has agreed to bill charges to someone else who fails to make payment promptly when due, Customer promises to pay South Rentals of Alabama on demand. If Customer directs charges to be billed to another person, Customer represents that he is authorized to give South Rentals of Alabama such direction. Customer understands that he remains individually responsible for all charges even if Customer directed South Rentals of Alabama to bill another person.

d. Final Audit - CUSTOMER UNDERSTANDS THAT ALL CHARGES ARE SUBJECT TO FINAL AUDIT. Customer authorizes any credits or additional charges to be made and paid by the method used at the time of the reservation, rental or return. 

(7) Customer agrees to pay in full replacement cost, including labor, for all damages to rental equipment due to any cause whatsoever.

(8) Unless waived by Customer’s initials next to the DAMAGE WAIVER charge on this contract, Customer agrees to pay a damage waiver fee which is a percentage of the rental fees in exchange for this damage waiver fee. South Rentals of Alabama agrees to modify paragraph 7 (above) of this contract and relieve customer of liability for damage to rental item(s) on the contract, and for loss due to fire, collision, windstorm, upset and riot. However, excluded from this waiver is any loss or damage due to theft, burglary, misuse or abuse, theft by conversion, intentional damage, mysterious disappearance or any loss due to Customer failing to care for the rented item(s) as a prudent man would his own property. Tire repairs of any kind are not covered by damage waiver.

(9) THERE ARE NO WARRANTIES OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR PURPOSE, EITHER EXPRESS OR IMPLIED. THE CUSTOMER HEREBY ACKNOWLEDGES THAT THE PRODUCT(S) DESCRIBED ON THE FRONT SIDE HEREOF WHICH IS THE SUBJECT OF THIS LEASE IS A USED PRODUCT AND IS BEING SOLD ON AN "AS IS" AND "WITH ALL FAULTS" BASIS. 

(10) RENTAL FEES ARE FOR PORTAL TO PORTAL TIME OUT NOT TIME USED, INCLUDING ANY PERIOD South Rentals of Alabama IS CLOSED. OVERDUE RATES FOR EQUIPMENT RENTALS ARE COMPUTED AT THE DAILY RATE FOR EACH HOUR OVER A DAY (24 HOURS). A ONE DAY RENTAL RATE FOR EQUIPMENT WITH RUN TIME HOUR METERS CONSISTS OF 8 HOURS USE WITHIN A 24 HOUR PERIOD. IF RUN MORE THAN 8 HOURS IN A 24 HOUR PERIOD AN ADDITIONAL PRO-RATA CHARGE WILL BE MADE. 

USED PRODUCT SALES CONTRACT-TERMS AND CONDITIONS

South Rentals of Alabama hereby sells as used products to the customer identified by his signature on the front side of this contract, the product(s) described on the front of this contract subject to all terms and conditions.

"AS IS" SALE WARRANTY DISCLAIMER

The Customer hereby acknowledges that the products described on the front side hereof which is the subject of this sale is a used product and is being sold on an "AS IS" and "WITH ALL FAULTS" basis.

South Rentals of Alabama, as the seller, makes no express warranties of MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE and THE LESSOR does NOT make and hereby disclaims any implied warranties OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE or any other express or implied warranties whatsoever, unless the warranty is provided in a separate writing and is signed by an authorized representative of South Rentals of Alabama. The Customer further understands that used goods are being sold and that should the goods prove defective so as to require servicing or repair, the Customer assumes the entire risk as to the quality and performance of the product(s) purchased and the Customer, and not South Rentals of Alabama, will assume the entire costs of all necessary servicing or repairs.

Furthermore, unless directly caused by South Rental of Alabama's sole negligence, the Customer agrees to defend, indemnify and hold South Rentals of Alabama harmless from all claims of liabilities, damages, losses, judgments, or costs whatsoever nature, relating in any way to the use of the item(s) rented or sold, whether such claims or liabilities concern loss(es) (real or personal) or injury to person, at all times following the execution of this contract. Customer expressly agrees to defend indemnify and hold South Rentals of Alabama harmless even when such claims, liabilities, losses, damages, liens judgments, and costs, of whatsoever nature are caused in part by South Rentals of Alabama's own negligence. The Customer further agrees to pay all court costs and reasonable attorney's fees and any other expenses as part of its obligation to defend, indemnify and hold South Rentals of Alabama harmless from claims, liabilities, losses, damages, liens, judgments, and costs, of whatsoever nature, which may be asserted against South Rentals of Alabama concerning the item(s) rented or sold/leased. 

The Customer, named on the reverse side hereof, acknowledges that he has read, understands and agrees to all of the above terms and conditions and that this is an "AS IS" Lease sale of use agreement.
